pursuant to section 21, paragraph 1, sentence 1 of the WpHG that on July 15, 2008 the voting rights of the above mentioned company in K+S Aktiengesellschaft, Kassel, Germany, fell below the threshold of 3% and each amounted to 2.85% on this day.
